The user is required to carefully read these General Terms and Conditions of Sale, which Dolomiti BioHemp makes available in the “Terms and Conditions of Sale” section of the Website and which may be stored and reproduced by the user, together with all other information provided by Dolomiti BioHemp on the Website, both before and during the purchase procedure.
1.4 These General Terms and Conditions of Sale apply throughout Italy and the European Union.
They do not govern the sale of products by parties other than Dolomiti BioHemp that may be present on the Website through links, banners or other hyperlinks. Dolomiti BioHemp shall not be held responsible for the sale of products by such third parties.

2.2 By accepting these General Terms and Conditions of Sale, the user acknowledges and agrees to hold Dolomiti BioHemp harmless from any liability arising from the purchase of a Product where such purchase or use violates the laws of the country in which the Product is ultimately used.
Dolomiti BioHemp does not sell or operate in any European country where products containing THC levels between 0.0% and 0.2% are prohibited.
The user is also responsible for verifying whether the laws and regulations of their own country permit or authorize the use of the Products offered for sale by Dolomiti BioHemp and whether such Products are considered lawful in the countries where they are permitted.
Accordingly, the user expressly releases Dolomiti BioHemp from any liability arising from any violation of the law referred to above, assuming full responsibility.
Dolomiti BioHemp informs its Customers that the Products sold and offered on the Website are intended exclusively for technical and collectible purposes and may not be used for any other purpose.
2.3 Dolomiti BioHemp reserves the right to refuse or cancel orders placed: (i) by a user involved in an ongoing legal dispute with Dolomiti BioHemp; (ii) by a user who has previously breached these General Terms and Conditions of Sale and/or the terms and conditions of a purchase agreement concluded with Dolomiti BioHemp; (iii) by a user involved in any kind of fraud, particularly fraud relating to credit card payments; (iv) by users who have provided false or incomplete identification details.
3. Registration on the Website
3.1 Registration on the Website is free of charge. To register, the user must complete the registration form by providing their first name, last name, email address, password, country and gender.
Registration will be confirmed by an email sent to the user. To complete the registration process, the user must click on the appropriate link contained in the email.
3.2 Registration credentials must be used exclusively by the user and may not be transferred to third parties.
The user undertakes to keep such credentials confidential, to ensure that no one else has access to them, and to promptly inform Dolomiti BioHemp by contacting Customer Service in the event of suspected unauthorized use and/or disclosure of the credentials. The user guarantees that the personal information provided during the registration process is complete and accurate. Each user may register on the Website only once. Multiple registrations by the same user are prohibited. Should Dolomiti BioHemp detect that the same user has registered more than once, it reserves the right to immediately suspend the relevant account without prior notice. 4. Information regarding the conclusion of the contract
4.1 Pursuant to Italian Legislative Decree No. 70 of 9 April 2003 governing electronic commerce, Dolomiti BioHemp informs the user that:
to conclude the purchase contract for one or more Products on the Website, the user must complete an electronic order form and submit it electronically to Dolomiti BioHemp by following the instructions provided on the Website throughout the various stages of the purchase process;
the contract is concluded when the order form reaches the server of Dolomiti BioHemp;
before submitting the order form, the user may identify and correct any data entry errors by following the instructions provided on the Website during the purchase process;
once the order form has been registered, Dolomiti BioHemp will send the user an order confirmation by email to the address provided by the user. The confirmation will include a summary of these General Terms and Conditions of Sale and any specific contractual conditions, information on the characteristics of the purchased Product, a detailed indication of the price, the payment method used, information concerning the right of withdrawal, delivery charges (where applicable), any additional costs, and the contact details of Customer Service, which the user may contact to request assistance and/or submit complaints.
Users are advised to retain the confirmation email as proof of purchase. The General Terms and Conditions of Sale applicable to the order, together with the standard withdrawal instructions and the standard withdrawal form referred to in Article 10, are available on the Website.
The order form will be stored in the database of Dolomiti BioHemp for the time necessary to process the order and, in any event, for the period required by applicable law.
4.2 The languages available for concluding the contract are Italian and English.
Customer Service is able to communicate with users in both languages.
5. Prices
5.1 All Product prices are expressed in Euro (€) and include Value Added Tax (VAT). Shipping costs and any other additional charges, also expressed in Euro (€) and inclusive of VAT, will be clearly and separately indicated in the order form before the user submits the order, as well as in the order confirmation email.
5.2 Dolomiti BioHemp reserves the right to change Product prices at any time without prior notice. However, the price charged to the user shall be the one published on the Product information page (“Product Sheet”) at the time the order is submitted.
Any price changes, whether increases or decreases, occurring after the order has been submitted shall not apply.
6. Purchase Orders – Product Information
6.1 Dolomiti BioHemp will process the purchase order and ship the purchased Product only after receiving confirmation of authorization for payment of the total amount due, consisting of the purchase price, delivery charges (where applicable), and any additional costs, except where the selected payment method is Cash on Delivery.
If the Total Amount Due is not paid or payment authorization is not successfully confirmed, the purchase contract shall be deemed automatically terminated pursuant to Article 1456 of the Italian Civil Code. The user will be promptly informed of such termination and the consequent cancellation of the order through the Website immediately after the order has been submitted.
6.2 The Products shall remain the property of Dolomiti BioHemp until the Total Amount Due has been paid in full by the user.
The user acknowledges that Dolomiti BioHemp shall not be liable for any damage, delay or loss of the Product from the moment it is entrusted to the courier responsible for shipment.
6.3 Dolomiti BioHemp offers hemp and CBD products in compliance with Italian Law No. 242/2016. All available Products are displayed on the Website.
6.4 Each Product is accompanied by a Product Sheet. The images and descriptions displayed on the Website reproduce the characteristics of the Products as accurately as possible. However, Product colours may differ from the actual colours due to the settings of the user’s computer or display device. Furthermore, the images shown on the Product Sheet may differ in size or include accessory products. Such images are therefore to be considered illustrative only and subject to normal tolerances. For the purposes of the purchase contract, the Product description contained in the order form submitted by the user shall prevail.
7. Product Availability
7.1 The Products offered on the Website are available in limited quantities. Therefore, also due to the possibility that multiple users may purchase the same Product simultaneously, it may happen that the ordered Product is no longer available after the purchase order has been submitted. Accordingly, upon receipt of the order request, Dolomiti BioHemp reserves the right to reconfirm the availability of the purchased items, verify the validity of the credit card transaction, and check the details of previous transactions made by the user on the Website.
7.2 In the event that the ordered Product is unavailable, without prejudice to the rights granted to the user by law, and in particular by Chapter XIV, Title II, Book IV of the Italian Civil Code, the user will be promptly informed by email. The user shall then be entitled to immediately terminate the contract. If the user exercises this right, Dolomiti BioHemp will refund the amount paid without undue delay and, in any event, within a maximum of 14 working days from the submission of the order. The refund amount will be communicated to the user by email. The refund will be credited using the same payment method used for the purchase. Any delay in the refund may depend on the banking institution, the type of credit card or the payment solution used. In any event, the value date of the refund shall be the same as that of the original charge.
7.3 In the case of orders including multiple Products (“Multiple Order”), where only some of the Products become unavailable after the order has been placed (without prejudice to the rights granted to the user by law, in particular Chapter XIV, Title II, Book IV of the Italian Civil Code, and without prejudice to the application of Article 7.2 above where all Products become unavailable), Dolomiti BioHemp will promptly notify the user by email. The user shall then be entitled to terminate the contract immediately, limited to the unavailable Product(s), in accordance with the Consumer Code. If the user exercises this right with respect to the unavailable Product(s), or if the total amount due has already been paid, Dolomiti BioHemp will refund the amount relating to the unavailable Product(s) within a maximum of 14 working days from completion of the shipment process. The refund amount will be communicated by email and credited using the same payment method used for the purchase. Any delay in the refund may depend on the banking institution, the type of credit card or the payment solution used.
In any event, the value date of the refund shall be the same as that of the original charge. Cancellation of the entire Multiple Order shall only be possible where the unavailable Product(s) are demonstrably and substantially ancillary to the remaining available Products included in the same Multiple Order.
8. Delivery of Purchased Products
8.1 Delivery is subject to a charge for purchases up to €49.00, while shipping and delivery are free of charge for purchases exceeding this amount. The delivery charges applicable to a specific order will be clearly and separately indicated (in Euro and inclusive of VAT) during the purchase process, in the order summary and, in any case, before the user submits the order.
These charges will also be displayed in the “My Account – My Orders” section of the Website and in the order confirmation.
Delivery times will be specifically indicated during the purchase process and in the order summary, and in any event before the user submits the order. They will also be specified in the order confirmation and in the “My Account – My Orders” section of the Website.
Where no specific delivery period is indicated, delivery shall in any case take place within thirty days from the date the contract is concluded.
8.2 The delivery obligation is fulfilled by transferring the physical possession or control of the Products to the Carrier or otherwise to the user.
The user is responsible for checking the condition of the delivered or collected Product. Users are advised to verify the number of Products received and ensure that the packaging is intact, undamaged and has not been tampered with. In their own interest, users are invited to report any anomalies on the carrier’s delivery document and to accept the parcel subject to reservation.
Acceptance of the Products without reservation shall prevent the user from making any claim against Dolomiti BioHemp or the carrier. Without prejudice to Article 6.2, if the packaging shows evident signs of tampering or damage, the user is invited to promptly notify Customer Service. In all cases, the legal provisions governing the right of withdrawal shall remain applicable.
8.3 Products purchased through the Website will be shipped and delivered to the address provided by the user when placing the order. Home Delivery shall be carried out, unless otherwise specified, by the courier on the days indicated on the Website.
Dolomiti BioHemp reserves the right to use different carriers, without prejudice to the delivery method selected by the user and the indicated delivery times.
8.4 Once the Products have been handed over to the courier, the user will receive a shipping confirmation email containing the tracking number, which may be used to monitor the shipment. The email will also include information regarding the delivery procedure, the collection deadline in the event of unsuccessful delivery due to the recipient’s absence, and the consequences of failing to collect the parcel within the specified period.
8.5 The user acknowledges that collecting the Product is a contractual obligation arising from the purchase agreement. If delivery cannot be completed due to the recipient’s absence at the address provided in the order form, the courier will be authorized to deliver the parcel to the nearest collection point, provided it is located within 3 kilometres of the delivery address. If no collection point is available, the courier will send a delivery notice by email and will attempt a second delivery on the following working day. After two unsuccessful delivery attempts, the parcel will be placed in storage.
As soon as the parcel enters storage, Customer Service will contact the user in order to arrange its release and ensure delivery as soon as possible. If the delivery attempt following Customer Service contact is also unsuccessful, the parcel will be returned to Dolomiti BioHemp.
The user acknowledges that if thirty (30) days have elapsed since the parcel was returned to Dolomiti BioHemp, the contract may be considered terminated and the purchase order cancelled pursuant to Article 1456 of the Italian Civil Code. Upon termination of the contract, Dolomiti BioHemp will refund the total amount paid by the user. The refund will be credited using the payment method selected during the purchase. Any delay in the refund may depend on the banking institution, the type of credit card or the payment solution used. In any event, the value date of the refund shall be the same as that of the original charge. If, before the expiry of the above thirty-day period, the user wishes to receive the purchased Product again, they may contact Customer Service to obtain all the information necessary to process the request.
9. Payment Methods
9.1 Payment for Products may be made by credit/debit card or by Cash on Delivery. If any of these payment methods cannot be used for a specific Product, this will be clearly indicated on the Website no later than the beginning of the purchase procedure.
9.2 A payment receipt will be issued automatically for every purchase.
10. Right of Withdrawal
10.1 A user acting as a consumer has the right to withdraw from the contract concluded with Dolomiti BioHemp, without giving any reason, within fourteen (14) calendar days (the “Withdrawal Period”).
The order must therefore be returned in accordance with the instructions provided by Dolomiti BioHemp no later than 14 working days. After this deadline, the return will not be accepted.
The Withdrawal Period expires after 14 days:
- in the case of an order relating to a single Product: from the day on which the user, or a third party other than the carrier and designated by the user, acquires physical possession of the Product;
- in the case of a Multiple Order delivered separately: from the day on which the user, or a third party other than the carrier and designated by the user, acquires physical possession of the last Product;
- in the case of an order consisting of a Product delivered in multiple lots or pieces: from the day on which the user, or a third party other than the carrier and designated by the user, acquires physical possession of the last lot or piece.
10.2 Exercising the Right of Withdrawal
To exercise the right of withdrawal in relation to an Order, the user must inform Dolomiti BioHemp of their decision to withdraw before the Withdrawal Period expires. To do so, it is sufficient to contact Customer Service at +39 333 7652415 or send an email to info@dolomitibiohemp.com describing the withdrawal request.
10.3 After exercising the right of withdrawal in accordance with Articles 10.1 and 10.2 above, the user must return the Product to Dolomiti BioHemp following the instructions provided by Customer Service.
The return of the Product to Dolomiti BioHemp is under the user’s responsibility.
10.4 If the user withdraws from the contract within the time limits and according to the procedures described above, Dolomiti BioHemp will refund the amount paid by the user for the Product no later than 14 calendar days from the day the Product is received at the warehouses of Dolomiti BioHemp.
The refund is subject to verification of the integrity of the Product. The refund will be made using the same payment method selected when placing the order. In any case, the user will not incur any fees as a consequence of such refund. If the user exercises the right of withdrawal, the security seal on the Product must not be cut or broken. The Product must not have been opened, altered or show any signs of use. The returned Product must be returned in the same condition in which it was delivered.
10.7 If the right of withdrawal has not been exercised in accordance with the applicable legal provisions, the contract shall not be terminated and the user shall not be entitled to any refund.

12.2 Contracts concluded between users of the Website and Dolomiti BioHemp shall be governed by Italian law. Consumer users who do not have their habitual residence in Italy shall nevertheless benefit from any mandatory provisions of the law of their country of habitual residence that are more favourable to them, in particular with regard to the time limit for exercising the right of withdrawal, the deadline for returning Products following withdrawal, the methods and formalities for communicating the withdrawal, and the legal guarantee of conformity.
12.3 If the user is a consumer, any dispute relating to the application, execution or interpretation of these General Terms and Conditions of Sale shall fall under the jurisdiction of the court of the place where the consumer resides or has elected domicile.
12.4 Pursuant to Article 141-sexies, paragraph 3 of Italian Legislative Decree No. 206 of 6 September 2005 (Consumer Code), Dolomiti BioHemp informs users qualifying as consumers under Article 3, paragraph 1(a) of the Consumer Code that, should they have submitted a complaint directly to Dolomiti BioHemp which has not resulted in the resolution of the dispute, Dolomiti BioHemp will provide information concerning the Alternative Dispute Resolution (ADR) bodies competent to settle disputes arising from contracts governed by these General Terms and Conditions of Sale (ADR bodies referred to in Articles 141-bis et seq. of the Consumer Code), specifying whether or not it intends to make use of such bodies to resolve the dispute.
Dolomiti BioHemp also informs consumers that an Online Dispute Resolution (ODR) platform has been established by the European Union. The ODR platform is available at http://ec.europa.eu/consumers/odr/. Through this platform, consumers may consult the list of ADR bodies, access the website of each body and initiate an online dispute resolution procedure.
In all cases, consumers retain the right to bring proceedings before the competent ordinary court, regardless of the outcome of any out-of-court dispute resolution procedure carried out under Part V, Title II-bis of the Consumer Code.
12.5 Users residing in a Member State of the European Union other than Italy may also make use of the European Small Claims Procedure established by Regulation (EC) No. 861/2007 of 11 July 2007, provided that the value of the dispute does not exceed €2,000.00, excluding interest, costs and expenses. The text of the Regulation is available at www.eur-lex.europa.eu.

All such elements are protected by copyright, trademark law, industrial design law, patent law and sui generis rights.
13.2 Accordingly, any reproduction, communication, download, modification or use, whether partial or total, of any elements belonging to Dolomiti BioHemp or to third parties, for any purpose and by any means whatsoever, requires the prior written authorization of Dolomiti BioHemp or of the respective intellectual property rights holders, except where expressly permitted by law. The user acknowledges and agrees that failure to comply with any of these obligations may result in civil and/or criminal proceedings.
